These terms govern all services and products provided by OmniSurge Digital. Please read them carefully before purchasing. By proceeding with any purchase or free trial you confirm that you have read and agreed to these terms in full.

 

 

1. Who We Are

OmniSurge Digital is a UK-based digital marketing and lead generation service operated as a sole trader. We provide lead generation, Google Business optimisation, social media content creation, landing page builds, review generation systems, and digital products to UK local businesses.

By purchasing any service or product from OmniSurge Digital you agree to these terms in full.

 

2. Services and Deliverables

We offer the following services:

        Free Trial: A 5-day free trial delivering a Google Business video audit and 3-point action plan. No payment is required. No obligation to continue.

        Flex: A pay-per-lead service charged at £200 per qualified lead delivered. A qualified lead is defined as a prospect with confirmed interest who has provided their contact details and agreed to be contacted by you.

        Growth: A monthly retainer at £800 per month including Google Business profile maintenance, 8 social media posts per month, and a monthly performance snapshot. Minimum 3-month term.

        VIP: A monthly retainer at £1,500 per month including everything in Growth plus 5 qualified leads per month, 12 social media posts per month, a monthly strategy call, and direct WhatsApp access. Minimum 3-month term. Shortfall guarantee applies — any leads not delivered in a given month roll over as bonus leads the following month.

        Google Business Optimisation: A one-off service at £200 delivered within 48 hours.

        Landing Page Build: A one-off service at £495 delivered within 5 working days.

        Review Generation System: A one-off service at £150 delivered within 48 hours.

        Digital Products: Downloadable digital products sold at fixed prices via Gumroad. All sales are final. No refunds on digital products once downloaded.

 

3. Payment Terms

All services must be paid in full before work begins. We do not offer credit, payment plans, or net payment terms.

Monthly retainer packages are billed automatically each month via Stripe on the same date as the initial payment. By purchasing a monthly package you authorise OmniSurge Digital to charge your saved payment method on a recurring basis until the contract is terminated in accordance with Section 6 of these terms.

Flex leads are charged at £200 per lead automatically to your saved card via Stripe at the point of delivery. By registering your card for the Flex service you authorise OmniSurge Digital to charge your card each time a qualified lead is delivered.

All prices are quoted in British pounds sterling and are exclusive of VAT where applicable.

 

4. Refund Policy

        One-off services: No refunds once work has begun. If we are unable to complete a one-off service due to circumstances within our control we will issue a full refund.

        Monthly retainers: No refunds on monthly payments already processed. If you cancel during a minimum term you remain liable for all payments due until the end of that term.

        VIP guarantee: If we deliver fewer qualified leads than the guaranteed amount in any given month the shortfall will roll over as bonus leads the following month. This is our sole obligation under the guarantee. No cash refunds will be issued in lieu of undelivered leads.

        Digital products: No refunds once a digital product has been downloaded or accessed.

        Free trial: No payment is taken during the free trial period and therefore no refund applies.

 

5. Client Responsibilities

To deliver your services effectively we require the following from you:

        Timely access to your Google Business Profile, social media accounts, and any other platforms specified in your onboarding form.

        Prompt completion of your onboarding form within 24 hours of payment.

        Provision of photos, logos, brand assets, and any other materials requested within 48 hours of our request.

        Accurate and truthful information about your business including your services, service area, and target customers.

        We cannot be held responsible for delays or underperformance caused by failure to provide the above in a timely manner.

 

6. Minimum Terms and Cancellation

Growth and VIP monthly retainer packages require a minimum commitment of 3 months from the date of first payment.

After the minimum term either party may terminate the agreement by giving 30 days written notice via email to [email protected].

Cancellation during the minimum term does not cancel outstanding payment obligations. All payments due within the minimum term remain payable in full.

Flex and one-off services have no minimum term and may be cancelled at any time with immediate effect.

 

7. Intellectual Property

All content, copy, graphics, and materials created by OmniSurge Digital on your behalf become your property upon full payment being received.

Our internal systems, processes, templates, prompt packs, and methodologies remain the intellectual property of OmniSurge Digital at all times and may not be reproduced, resold, or shared without written permission.

 

8. Results Disclaimer

We are committed to delivering high quality work and measurable results. However we cannot guarantee specific outcomes including but not limited to a specific number of new customers, a specific revenue increase, or a specific search ranking position.

Results depend on factors outside our control including your market, your competition, your response speed to leads, and the quality of your own product or service.

The VIP lead guarantee is the only specific result guarantee offered by OmniSurge Digital and is subject to the terms set out in Section 4 of this document.

 

9. Confidentiality

Both parties agree to keep confidential any proprietary or sensitive information shared during the course of the working relationship. This includes but is not limited to client business strategies, pricing, customer data, and internal systems.

This obligation of confidentiality continues for 12 months after the termination of any agreement between the parties.

 

10. Limitation of Liability

OmniSurge Digital's total liability to you for any claim arising from our services shall not exceed the total amount paid by you to OmniSurge Digital in the 30 days preceding the claim.

We are not liable for any indirect, consequential, or special damages including lost profits or lost business opportunities.

 

11. Governing Law

These terms are governed by the laws of England and Wales. Any disputes arising from these terms or our services shall be subject to the exclusive jurisdiction of the courts of England and Wales.

 

12. Changes to These Terms

We reserve the right to update these terms at any time. We will notify existing clients of any material changes by email with at least 14 days notice. Your continued use of our services after that date constitutes acceptance of the updated terms.
